Why do so many MSHA inspectors mark electrical citations as fatal?
1. Their Academy instructors, managers, and supervisors tell them to mark all electrical citations as fatal.
2. The Industry has historically accepted inspectorsí word as "Law" without question and not required them to prove their far-fetched appraisals.
3. They are being told that we are too frightened and stupid to challenge them on their false assumptions.
The Constitution and the federal enforcement statutes place the burden of proof upon MSHA and its inspectors. They must prove it probable to result in death instead of having us assume that it could possibly result in fatality.
We must exercise the right given us in the Act and "formally contest" all citations which have allegations which the inspector has not proven to our satisfaction!
