Your people knowing the Law is your only protection! Here is the photographic proof that some MSHA inspectors are making it up as they go along. Only the Foreman's knowledge of the Mandate and the $afe Production Inspection Process kept this firm from the expense of unnecessary repairs to the highwall! The first photo was taken from a top the high wall. The inspector said he was concerned about such a large fracture and wanted to take a look from down below.
This photo was taken in the pit, same formation but from a different angle. As you can see, by the traffic pattern, the loader has not been in an area of danger.
In this photo the inspector called an employee over and is explaining the danger of the outcropping. The inspector is standing under the “So Called Danger”.
Again, in this photo the inspector has now moved directly under the “So Called Hazard” and is investigating the traffic pattern of the loader. ![]() He really wanted to issue a citation but the Foreman, J**** S******, and the Drill Operator, were able to convince the inspector that there was no hazard and he was not happy that I snapped a photo of him standing under the “Hazard”. The Foreman asked him what standard he intended to cite and the inspector simply said he would have to think about it. A few moments later he informed me that he did not intend to write the citation.
