Reports were received of a M/N District threatening a larger Producer.
If they do not comprehensively train customer truck drivers in Part 46 , the District will issue orders on all of the sites within the District. This is a clear reversal of the plain language of 30CFR without following the required rulemaking procedure. District Managers do not have the mandate to unilaterally change Law or Enforcement policy!
· Part 46.2 (2) states: The definition of "miner" does not include scientific workers; delivery workers; customers (including commercial over-the-road truck drivers); vendors; or visitors. This definition also does not include maintenance or service workers who do not work at a mine site for frequent or extended periods.
· 46.2 (h) Mining operations means mine development, drilling, blasting, extraction, milling, crushing, screening, or sizing of minerals at a mine; maintenance and repair of mining equipment; and associated haulage of materials within the mine from these activities.
