New Changes to Civil Penalty Payment Process
MSHA is implementing several new changes to improve its
civil penalty payment process. These changes are intended to
streamline the debt collection process and make it more user
friendly for everyone.
New Mailing Address- Beginning October 1, all
payments for civil penalties must be mailed to a new
address: U.S. Department of Labor/MSHA, P.O. Box 790390, St.
Louis, MO 63179-0390. (Note: This is a
US Postal service address. FedEx or UPS will be returned.
The 30 day period for paying the fine is based on calendar
days!)
Electronic Funds Transfer- Payments made by check
will be converted into electronic funds transfers and
electronically debited to a company's account. Debits will
usually occur within 24 hours and will appear on regular
account statements
Assessment
Statement Delivery- MSHA will deliver monthly Assessment
Billing Statements via Federal Express. Federal Express
delivery requires a street address and not P.O. Box or
Drawer.
Beginning September 17, 2007, MSHA will deliver your
monthly Assessment Billing Statement via Federal Express
(FedEx). FedEx delivery requires a street address (not a
PO Box or Drawer). As a result, we will be using the street
address from the most recent Legal Identity Report (MSHA
form 2000-7).
MSHA asks that
companies ensure that the Address of Record reported on the
Legal Identity Report is correct. If another address is
desired, please update the Mine's Legal Identity Report.
This can be done by filing a paper copy that can be obtained
from the mine's servicing district office, or online by
accessing the Agency's website, Mine Safety and Health
Administration (MSHA) - U.S. Department of Labor -
Forms and Online Filings (www.msha.gov under the
Forms/Online section of Quick Links).
Independent
contractors must also ensure that their records with MSHA
are up to date and contain a street address. Contractors
should provide MSHA with the following information:
Contractor ID, Contractor Name, Street Address, City, State
and ZIP Code, and Phone Number.
New Civil Penalty Provisions- Significant changes
were made to 30 CFR Part 100, Criteria and Procedures for
Proposed Assessment of Civil Penalties. The changes became
effective on April 23, 2007. The significant changes made to

The final rule (07-1402 - 30 CFR Part 100 - Criteria and
Procedures for Proposed Assessment of Civil Penalties) that
was published March 22, 2007, may be viewed using

Upcoming Improvements
- PIB on Violations per Inspection Day (VPID)
- New web tool--Allows companies to review their
history and how assessments are broken down. This will
be available via the Data Retrieval System on a
mine-by-mine basis.
