"Whoops . . . MSHA's totally whacked out now. Things are getting stranger and stranger. Today (4/3/07), a DISTRICT MANAGER, ASST DISTRICT MANAGER, SPECIAL INVESTIGATOR and 8 others showed up at a start up operation (not yet mining) when NO ONE was there and did an investigation, then called the owner and demanded he come over. To me, this is trespassing. The DM made threats that they'll write citations so the mine cannot ever open up. The developer told me he thought the DM was drunk. What the **** is going on? Are they drinking the kool-aid?" It appears that in violation of Constitutional Rights MSHA is embracing authoritarianism as a "citation-generating tool" and an attempt to drive Mining Firms into submission to their will or out of business. Large investigation teams descending on a site and threatening legal roadblocks that can prevent a business from opening certainly smacks of it. It perceives the Industry as powerless and submissive and therefore a target for economic intimidation. In some sense, authoritarianism describes a form of social control characterized by strict obedience to the authority of an organization, often maintaining and enforcing control through the use of oppressive measures. Contacting our Lobbyists is not enough to stifle this intimidation attempt by MSHA. It is time to barrage our Senators and Representatives with emails, letters, and phone calls demanding oversight of the oppressive enforcement procedures by the agency.
